Linda is a commercial litigator with trial experience. Linda focuses her litigation practice on complex commercial litigation. She counsels and represents clients in diverse matters, including business torts, contract issues, intellectual property disputes, and energy-related litigation.
Represented the former officers and directors of a bankrupt subsea construction and commercial diving company as lead associate in a securities fraud class action; defeated class certification and achieved a favorable settlement after discovery.
Represented the former officers and directors of a bankrupt subsea construction and commercial diving company as lead associate in a breach of fiduciary duty case; prevailed on a motion to dismiss the majority of plaintiff’s claims.
Represented a Texas bank as lead attorney in a bench trial in federal court involving maritime liens, a first preferred ship mortgage, and various state law fraud and negligent misrepresentation claims.
Represented the defendant oil services company as lead attorney in a breach of contract and fraud case involving drill pipe; achieved dismissal of all claims on summary judgment.
Represented a Mexican energy company as lead associate in arbitration with an international freight forwarder involving damage to a loading arm; achieved a favorable settlement on the first day of arbitration.
Represented the plaintiff private investment firm as lead associate in a securities and common law fraud case arising from the firm’s purchase of two natural gas storage facilities for over $500 million dollars; defeated a motion to dismiss.
Represented the plaintiff oil services company as lead associate in a breach of contract and suit on account case.
Represented the defendant Chinese energy company and its U.S. subsidiaries in a case involving civil claims under the Anti-Terrorism Act; prevailed on a motion to dismiss all claims.
Assisted the legal team of a large international petroleum company in designing and implementing a records retention program; part of team coordinating the roll out of the new program across company departments.
Represent developer of closed loop solids control system designed to improve functionality of existing shale shakers in processing drilling fluid and drying drill cuttings in patent litigation.
Represent oil and natural gas exploration and development group in real property dispute regarding competing claims to various mineral interests; prevailed on motion for new trial after adverse ruling on summary judgment and subsequently negotiated a settlement agreement.
Represent publicly traded oilfield services company in connection with disputed indemnification obligations arising under master service agreement with drill site operator; negotiated favorable settlement after mediation.
Represent publicly traded oilfield services company in coverage dispute with excess insurance providers.
Represent the Nigerian subsidiaries of an international drilling company in an action to confirm two foreign arbitration awards under the New York Convention in the Southern District of Texas; defeated the opposition to confirmation based on lack of subject matter jurisdiction and achieved confirmation of both awards.
Represent oil services company in a breach of contract and suit on account case; achieved settlement before discovery.
Represent officers and directors of closely-held corporation in derivative litigation asserting claims by minority shareholder for breach of fiduciary duty.
